From what I was told from several reliable sources is that Jay was in breach of contract from a previous court order. WB set him up with a buyer from their Legal Division, the buyer was in contact with Jay and went to his to his shop to make contact, when he showed him what he had. WB pounced and took all items that were Batman related, he lost a lot more than the 66.

When AOL dropped their "Picture Place" in favor of another photo-hosting site, I wasn't able to find any easy way to transfer all of my images
(2000+) there to re-post easily. I have every single image, letter and IM that I ever received in the due course of my (pathetic) first build. At some point
Iwill re-post them all, but in light of the litany of stories pouring out of dealings from "that camp" anyone with internet access should be able to
reasonably conclude the jeopardy that may be expected from that element based on the other postings on literally every bat-related website.
There are numerous other reliable (good-guy) alternatives for the average guy to realize Batmobile ownership if desired. Rather than roll the dice with uncertainty given the current economic climate why not save yourself the grief? |

WB confiscated quite a bit of Bat related items Bat boat, 66, 89, partially completed Tumbler, 89 Bat shield, various molds and other items. Some of which do not belong to Jay, the owners were told to produce proper ownership documentation and they would release their item to them. |

Ain't gonna happen nodey much to your dismay. 29 Batmobiles built to date, all smiles per gallon, when you get your first one built you'll finally be
able to experience happiness on a large scale. I've been fortunate to experience it several times over and met many great people along the way.
So wipe those blues away and smile today!

Apparently you not only cannot discuss the details of your build online anywhere with anyone on Batmobile discussion forums, but you can't reply to
e-mails from individuals who ask specific questions or the author of this letter may file suit against you.
I wonder how many people have to be threatened by suit as a means to deter any post build discussion about it for the benefit of others on a BATMOBILE DISCUSSION FORUM (key words)? Should suit arise from this letter the contents of the suit will become a matter of legal record instead of just one persons experience. The following letter is without merit submitted for your consideration.

Funny, I always thought you had to say/publish something that was false or fabricated to be guilty of slander or libel. I also never knew it's illegal to
say something derogatory about someone, especially if it is true, unless there's some sort of contract or gag order previously put in place (ie.
confidentiality of medical records, or paying a bunch of money in a divorce under the condition that your spouse can't disclose the amount of money or say
anything bad about you). Last I heard, the first amendment hadn't been repealed yet. I don't see a court order to cease and desist, either--just a
demand and threat from a lawyer, who might not know how many other dissatisfied past "clients" might be willing to come forward and corroborate the
allegedly slanderous statements (and photos???). I'm sure this is a futile attempt to obstruct the plaintiff suing MT from pre-trial discovery of
evidence.

He'd only have a case if he could prove you said something that cost his business actual monetary losses (which of course he would have to be able to
PROVE). That is a tough thing to prove typically. REAL TOUGH to prove and the burden would be on him to prove it in the first place.
And he'd likely have to get that lost customer to testify IN COURT that they specifically stopped business with him based on something somebody in particular said to them. But even then he'd have to prove what was said was done with the INTENT to cause a loss or harm to his business, which is different than having an opinion on a web chatroom full of older guys 98% of whom cannot afford a batmobile and never will. As noted in the previous post, it's clearly a defense measure to try and scare people from going to his opponents side of this case, he's trying to keep as many sticks out of the fire as he can. Some people get really scared when a lawyer sends them a letter or maybe they have other things going on in their lives and just don't need the hassle, so many times these "scary letters" are all they need to do to quiet people. I say "Good luck"....too many of us have personal experiance and didn't need anyone else to scare us away from his shop! But I also think it's really too bad that a business of this nature would end up with ANY bad press from anyone, I did custom body work for the first half of my working years and car people are really a fun bunch to be with when it comes to custom stuff, really a shame! |

C&D letters from attorneys are used to intimidate, the only enforceable C&D orders have to come
from a Judge. It looks like several others have received similar Orders, which are as worthless as the paper they are written on. I guess Mark is
running up a big attorney fee if nothing else......
